General
Customer is referred to in this text as any individual who visits hangarbuds.com or purchases products and/or services from hangarbuds.com or their partner CFI Stores. A CFI store is a store used by an independent CFI to sell aviation products. Hangarbuds is a DBA of MAS Aviation LLC. Hangarbuds services and products are offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your agreement to obtain products and/or services from Hangarbuds constitutes your agreement to all these Terms. Please read these terms carefully, and save the link to these terms and conditions. Saving the link ensures that mechanics and customers have the most up to date version of these terms.
Electronic Communications
Visiting hangarbuds.com or a partner CFI store or sending emails to Hangarbuds constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
Links to Third Party Sites/Third Party Services
Hangarbuds.com has not reviewed, and cannot review, all of the material, including computer software, made available through any third party websites and webpages to which hangarbuds.com links, and that link to Hangarbuds.com. Hangarbuds.com does not control such websites and webpages and is not responsible for their contents or their use. Such links should not be interpreted as approval by Hangarbuds.com of those linked websites or information you may obtain from them. By linking to a website or webpage, Hangarbuds.com does not represent or imply that it endorses such website or webpage. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, logic bombs, and other material that is malicious or technologically harmful (collectively, the “Technologically Harmful Content”). Additionally, you agree not to introduce any Technologically Harmful Content to Hangarbuds.com. Hangarbuds.com disclaims any responsibility for any harm resulting from your use of third party websites and webpages.
Product Returns & Refunds
Before returning any product, contact Hangarbuds Customer Service as a RMA (Return Merchandise Authorization) number and return shipping instructions are required to process a return. Submitting an RMA request does not automatically constitute authorization. This can be done by filling out a product return form. It is the customer’s responsibility to verify application eligibility prior to starting the install. Hangarbuds is not responsible for parts installed incorrectly due to suggested applicability. It is the duty of the purchaser / installer to verify eligibility prior to install.
Merchandise that cannot be returned:
– Any part that holds a PMA, TSO or STC that has been used, tested or installed.
– Any part that has a shelf life – Batteries, Oil, Paint, Life Vest/Raft, Hazardous Material etc.
– Books, Videos, Software, Tools, Cut Material etc.
– Parts specified as ‘Final Sale’.
– Special order parts.
Merchandise that can be returned:
Eligible merchandise as outlined below may be returned for credit or refund within 30 days from date of shipment only if all of the following conditions are met. Otherwise a 18% restocking fee may apply. Return shipping costs are the responsibility of the customer unless it was a result of our error. If shipping was prepaid on the original order, prepaid freight will be deducted:
– Parts must be returned in new, resalable and uninstalled condition.
– Packed in original manufacturer’s box with no marking or labels on box.
– Complete with instructions and all components provided by the manufacturer.
– If part shipped with an 8130, documentation must be included.
Credits for returned merchandise outside of 30 days are based upon an evaluation if the RMA is approved and is subject to:
– A minimum 18% restocking fee.
– Any manufacturer’s additional test or recertification fees.
– House account credit only.
Merchandise experiencing technical issues or are assumed defective:
Apply to manufacturer’s warranty policy. Must be sent to manufacturer for evaluation for repair or replacement as per the manufacturer’s warranty policy. If you need information about the manufacturer’s warranty policy or contact information, please contact our customer service team.
Damaged or shorted merchandise:
Each parcel carriers $100.00 insurance against loss or damage. Additional insurance coverage will be added as required per parcel. Open and examine all packages promptly. Notify the Aero Performance Customer Service Department within 14 days of any discrepancies in the order. If the merchandise is received in damaged condition or the carrier fails to deliver the entire shipment as shown on the Bill of Lading covering motor freight delivery, make note of the damage or shortage on the Bill of Lading and ask the driver to sign it. Please ship your return with the RMA number clearly on the shipping box, not the product box, prepaid and insured to the address located in your return paperwork.
Credit card refunds, once approved, will be issued to the same credit card used on the original order. Please allow 10 business days after credit has been approved for your return and refund to be processed. Do not return any products C.O.D. as it cannot be accepted by our warehouse.
Ecommerce Store Subscriptions
Ecommerce store subscriptions which include CFI store subscriptions are offered to aviation professionals wishing to do business with Hangarbuds. Ecommerce store subscribers can cancel their subscription anytime by emailing office@hangarbuds.com or by canceling inside their Hangarbuds my account page.
Ecommerce Store Customization
Hangarbuds ecommerce stores are offered to aviation professionals as a turn key solution to sell aviation products. Ecommerce store subscribers are able to change the store name, and colors. Additional customization may cost 50.00 dollars per hour to implement into the ecommerce store. All ecommerce store customization is at the discretion of Hangarbuds.
Indemnification
The Customer agrees to indemnify and hold harmless and defend Hangarbuds member(s), officers, employees, and contractors from and against all claims and suits for damages, injuries to persons (including death), property damages, losses, and expenses including court costs and reasonable attorney’s fees, arising out of, or resulting from, Hangarbuds performance under this Agreement, including all such causes of action based upon common, constitutional, or statutory law, or based in whole or in part, upon allegations of negligent or intentional acts on the part of Hangarbuds, its officers, employees, agents, contractors, licensees, or invitees.
Arbitration
All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the state of Iowa. An award of arbitration may be confirmed in a court of competent jurisdiction.
Changes to Terms
Hangarbuds reserves the right, in its sole discretion, to change these terms. The most current version of the Terms will supersede all previous versions. Hangarbuds encourages you to periodically review the Terms to stay informed of our updates.
